The Cape May - Lewes Ferry Loyalty Program Rules & Regulations

IMPORTANT, PLEASE READ FIRST: By enrolling in the Cape May – Lewes Ferry Loyalty Program, you agree to the current Rules governing the accrual and redemption of points, awards, and benefits. The latest version of the Rules is always available on this page and supersedes any prior versions.

GENERAL CONDITIONS: The Loyalty Program is offered at the discretion of the Cape May – Lewes Ferry, which reserves the right to modify or terminate the Program, including its rules, benefits, qualifications, and redemption levels, at any time, with or without notice. 

The Cape May – Lewes Ferry may:

  • Adjust or cancel awards and benefits, including VIP status or redemption criteria.
  • Limit the availability of awards, blackout dates, or redemptions for specific sailings.
  • Make promotions available selectively to Members based on participation, location, or other factors.
Members should not rely on the continued availability of any specific benefit or award. Redemption may be restricted or paused following account creation or due to the Cape May – Lewes Ferry policy. 
 
Program rules govern all participation. The Cape May – Lewes Ferry has sole discretion to interpret and enforce these rules. If a benefit or accrual is denied in error, The Cape May – Lewes Ferry’s liability is limited to the equivalent value of the denied benefit. 
 
Prohibited conduct, such as fraud, abuse, or violation of Program or Partner rules, may result in:
  • Termination of membership and any associated VIP status. 
  • Forfeiture of accrued points, awards, or benefits.
  • Denial of travel or the requirement to pay the standard fare.
  • Repayment of misused rewards and potential legal action.
Terminated members may not re-enroll without express consent from the Cape May – Lewes Ferry.
 
The Cape May – Lewes Ferry reserves the right to audit, investigate, suspend, or cancel any Loyalty Program account at any time if Prohibited Conduct is suspected. During such review, account activity, including redemptions and benefits, may be paused or revoked. Customer account information may be shared with third-party partners assisting with the investigation. If misconduct is confirmed, appropriate remedies may be taken, including loss of points, benefits, or account termination.
 
Members are responsible for:
  • Staying informed of the Program Rules and their account balances.
  • Promptly reporting any account errors.
  • Ensuring contact details are up to date (the Cape May – Lewes Ferry is not responsible for misdirected communications).
  • Maintaining the confidentiality of account credentials and access.
Points and benefits do not represent ownership rights, are non-transferable, and may only be used by the named Member unless otherwise approved in writing by the Cape May – Lewes Ferry. Members may not combine multiple accounts or transfer awards without express permission.
 
Membership is limited to individuals, with one account per person unless otherwise authorized. The Cape May – Lewes Ferry reserves the right to cancel duplicate or ineligible accounts. Account access and information are proprietary and are only for personal account management.
 
In specific cases such as death or divorce, the Cape May – Lewes Ferry may, at its discretion, transfer accrued points to an authorized party upon receipt of satisfactory documentation and payment of applicable fees.
 
All determinations related to the value of benefits, point accumulation, qualification for VIP status, and any recalculations or estimates are made at the sole discretion of the Cape May – Lewes Ferry and will be considered final.
 
Any prior waiver, consent, or exception granted by the Cape May – Lewes Ferry does not prevent enforcement of the Rules in the future. Even if the Cape May – Lewes Ferry allows a deviation once, it may still apply appropriate remedies for any future or continued violations.
 
PROHIBITION OF SALE OR BARTER: The sale, barter, or unauthorized transfer of points, certificates, awards, benefits, or status is strictly prohibited. Any attempt to do so may result in account suspension, loss of benefits, or other corrective actions. Only transfers explicitly permitted or sponsored by the Cape May – Lewes Ferry are allowed.
 
PARTNERS: “Partners” include third-party companies (e.g., tour providers, rental car companies, hotels) that may offer products, services, or benefits to Program Members. The Cape May – Lewes Ferry is not responsible for the quality, availability, or terms of Partner-provided services.
 
Partner offers are subject to change or may be withdrawn at any time. The Cape May – Lewes Ferry is not liable for:
  • Partner withdrawal from the Program.
  • Changes or cancellations to awards or promotions.
  • Discontinued products or services.
Eligibility for earning or redeeming points with Partners may be restricted by law or Program policy. Terms of Partner offers are governed by the Partner’s conditions and may include limitations or blackout periods.
 
PRIVACY POLICY: By participating in the Loyalty Program, Members authorize the Cape May – Lewes Ferry to collect and use personal information, including names, contact details, and account data, in accordance with our Privacy Policy. This policy is a general statement of practices and not part of the Program Rules.
 
POINTS ACCRUAL:
  • Points may only be earned through qualifying activities after official Program enrollment, and only by the individual Member utilizing ferry services.
  • Points are non-transferable and not awarded for cancellations or certain fare types (e.g., group rates, promotions, or discounted fares).
  • Members may need to provide a password or security credentials for account transactions and are responsible for keeping this information secure.
  • The Cape May – Lewes Ferry is not liable for redemptions made using a member’s credentials without the members knowledge or consent.
  • Points for Partner services will only be credited to the account number used at the time of the transaction and are subject to the Partner’s terms.
  • The Program reserves the right to adjust qualifying activities and accrual methods at any time.
 
CLAIMS ABOUT MEMBER BALANCES: While the Cape May – Lewes Ferry aims to accurately credit all Member accounts, Members are responsible for reviewing their balances and reporting any discrepancies.
  • If you believe earned points were  not credited, you must submit supporting documentation (e.g., receipts or tickets) within 12 months of the transaction.
  • Similarly, report any errors or unauthorized point deductions within 12 months of the transaction.
  • The Cape May – Lewes Ferry will review claims and determine adjustments at its sole discretion, and all such decisions are final.
  • Points remain active unless redeemed or forfeited due to inactivity (24 months), account closure, prohibited conduct, or other stated reasons.
AWARD REDEMPTION: The Cape May – Lewes Ferry defines all award structures, including the points required, availability, and terms, and may adjust or withdraw awards at any time.
  • Redemption of points may be restricted based on Program policy or applicable law.
  • Awards can be issued for the Member or a designated person for non-commercial use only.
  • A password or security confirmation is required to redeem awards.
  • Changes or cancellations to an issued award may incur a service charge.
  • If a points award is canceled in line with Program or fare rules, points may be recredited and may be subject to a service fee (unless otherwise stated).
  • Awards are only valid for destinations served at both the time of booking and departure. The Cape May – Lewes Ferry and its partners are not responsible for schedule changes.
  • Failure to comply with award terms may result in denial of boarding or alternative travel arrangements without compensation.
DISPUTES: If you have a concern related to the Loyalty Program, you must first notify the Cape May – Lewes Ferry via email, providing a description of the issue. You agree to allow up to 60 days for the Cape May – Lewes Ferry to respond and attempt to resolve the matter before initiating any legal, administrative, or arbitration proceedings.
 
Failure to follow this process may result in the Cape May – Lewes Ferry recovering reasonable attorneys’ fees incurred in defense of an improperly filed claim.
 
CLASS ACTION WAIVER: By participating in the Program, you agree that all disputes will be resolved individually. You waive the right to act as a class representative or participate in any class, collective, or representative action against the Cape May – Lewes Ferry, including consolidated legal proceedings.
