 Official Contest Rules 

No purchase or payment of any kind is necessary to enter or win this competition. A purchase will not increase your chances of winning. Registration with Instagram/TikTok is necessary to post comments.  

• You agree that, by completing the following actions, you will be bound by these Official Rules, and you acknowledge that you release all rights to the comments with your name, for general viewing and use by The Delaware River and Bay Authority, the owner/operator of the Cape May - Lewes Ferry (CMLF).  

Required Actions/How to enter:

• Participation constitutes winner’s consent to use of winner’s name, likeness, voice, photographs, video, opinions, statements for promotional purposes in any manner or media (including, without limitation, online), worldwide, in perpetuity, and without further payment, consideration, notice, review or consent. 

 • By participating in this giveaway, you completely release Instagram/TikTok of any liabilities, acknowledge that the promotion is no way sponsored, endorsed or administered by, or associated with Instagram/TikTok and acknowledge that you are providing information to the Delaware River and Bay Authority and not to Instagram/TikTok.  

• Eligibility: If you are an individual legal resident of the 50 United States or the District of Columbia and are 13 or older at the time of entry, you are eligible to enter the Competition. Submissions from individuals under 18 years of age can be submitted, but a legal guardian will be required to receive a prize.   The entrant selected must comply with all terms and conditions of these Official Rules, and winning is contingent upon fulfilling all requirements and requests of Sponsor during the verification process. 

• DRBA employees, officers and directors and their immediate family members (spouses, domestic partners, parents, grandparents, siblings, children and grandchildren), advisors or advertising/promotion agencies (and their immediate family members) are not eligible to win any of the prizes but are eligible to post comments to the Instagram/TikTok pages.   

• Winners will be required to show proper identification at the time of the award. Minors will be required to have a guardian to take possession of the award.  

• Only comments made by persons posting the material are eligible to win. No copyright material is eligible for posting or winning.  In the event of a dispute as to an entrant’s entry, the natural person who is the authorized account holder will be deemed to be the entrant, but only if that person is otherwise eligible to enter the Promotion. If a dispute cannot be resolved to Sponsor’s satisfaction, the winning entrant may be deemed ineligible.  

• How to Win: Winners will be selected by a random drawing from among all eligible contest entrants.  

• Prizes: DRBA will award prizes after the end of the two-week contest period. Entrant(s) will be selected as the winner by random draw and will each receive: One Cape May-Lewes Ferry standard vehicle round-tip with up to four passengers and One Avelo Airlines Round Trip Ticket to any destination departing from Wilmington Airport (ILG).    

• Prize Announcement: DRBA will announce the potential winners via CMLF Instagram story following the end of the competition on April 15th and tell them how they can claim their prize. We will select an alternative potential winner if any potential winner does not claim the prize within 24 hours of notification, or otherwise fails to meet the eligibility criteria.   

• Odds of Winning: Odds of winning depend on final number of participants. 

• Additional Terms: DRBA and their promotional agents reserve the right to remove comments without notice or explanation.  It is at the sole discretion of DRBA what it considers inappropriate and unsuited for general public viewing.  

• DRBA may, to the maximum extent permitted by law and in our sole discretion, change these rules or suspend or cancel the Competition at any time. DRBA becomes the sole owner of the posted comments and may promote them or use them in promotion without additional permission or credit. DRBA is not responsible for any malfunctions at Instagram/TikTok or with computer equipment, transmission entries, or for technical, network, telephone, computer, hardware or software, malfunctions of any kind, or inaccurate transmission of, or failure to receive any entry information on account of technical problems or traffic congestion on the Internet or at any website. We may, in our sole discretion, disqualify any individual found to be: tampering with the entry process or the operation of the competition or website; acting in violation of these rules; or acting in an unsportsmanlike or disruptive manner or with intent to annoy abuse, threaten or harass any other person. If you use robotic, automatic, programmed or similar entry methods, your entry will be void. No greater than the number of prizes stated in these Official Rules will be awarded.  

• Miscellaneous:  If you win a prize, you may not redeem the prize for cash. All decisions and awards are final. Winners will be announced on Instagram. 

• Release:   By entering, you fully and irrevocably release and holds harmless the DRBA, its officers, directors and employees, agents, advertising and promotion agencies, affiliates, Promotion partners and prize suppliers, from and against all claims, damages or liabilities arising in whole or in part, directly or indirectly, from entrant’s participation and/or entry and/or entrant’s award, receipt or use of any prize awarded.  

• Disputes: Any and all disputes, claims and causes of action arising out of or connected with this promotion, or any prizes awarded shall be resolved individually, without resort to any form of class action, and solely and exclusively in a federal or state court located in the State of Delaware; entrant submits to sole and exclusive personal jurisdiction to said courts in the State of Delaware for any such dispute and irrevocably waives any and all rights to object to such jurisdiction; (b) any and all claims, judgments, and awards shall be limited to actual out-of-pocket costs incurred, but in no event attorneys’ fees; and (c) under no circumstances will entrant be permitted to obtain awards for and entrant hereby waives all rights to claim punitive, incidental, consequential, and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of entrant or Sponsor in connection with the Promotion shall be governed by, and construed in accordance with, the laws of the State of Delaware, without regard to choice of law provisions.
